Chicago Shared Housing Rules (2026)

Chicago allows short-term rentals of 31 nights or fewer only when the unit is registered with the Department of Business Affairs and Consumer Protection (BACP) under the Shared Housing Ordinance. Eligibility, not demand, is the first question for any Chicago owner, so we check it before anything else.

Shared housing registration – every unit needs its own registration, about $250 per year, and the registration number must appear on every listing. Hosts with two or more registered units also need a Shared Housing Unit Operator License.

Primary residence rule – in single-family homes and two- to four-unit buildings, the unit generally must be the host's primary residence, and larger buildings face caps on how many units can be rented short term.

Prohibited buildings and restricted precincts – buildings on the city's Prohibited Buildings List and voting precincts that have opted out cannot host shared housing at all, so we check both before you invest.

Lodging taxes – the city's 4.5% hotel accommodations tax and 6% shared housing surcharge stack with Illinois and county hotel taxes, bringing the total to more than 20% of each booking. Platforms collect part of this; we confirm the rest.

Fines for unregistered or non-compliant rentals are steep, so confirm current rules with BACP before listing. If a unit does not qualify, we tell you upfront and walk through other options such as longer furnished stays.
